Tornante · Terms of Service

These Terms govern your use of the Tornante mobile application (“the App”), developed by Diego Bianchi (“the Developer”). By using the App you agree to these Terms. If you do not agree, do not use the App.

Pre-release builds. Alongside the released App, Tornante is also distributed as pre-release builds via Apple TestFlight. Beta software is provided for evaluation, may contain errors, and may change or stop working at any time.

1. What Tornante is, and is not

Tornante generates and speaks rally-style pacenotes (spoken corner descriptions) for a road you choose, timed to your position while you drive.

Tornante is provided for informational and entertainment purposes only. It is not a safety device, not a navigation system, and not a substitute for your own attention, judgment, and control of the vehicle.

All pacenotes, corner severities, distances, and elevation calls are computer-generated estimates derived from public map and elevation data. They can be wrong, late, missing, or outdated: roads change, map data contains errors, GPS drifts, and the App’s algorithms have limitations. Never rely on a pacenote as an assurance that a road is clear, safe, or as described.

2. Safety rules and acceptable use

By using the App you agree that you will:

  • Always drive within your own limits, the applicable traffic laws, posted limits, and the actual road, traffic, and weather conditions. The road you see always overrides anything the App says.
  • Never operate or look at the phone while driving. Set up the stage before departure; interact with the screen only when safely stopped. The App is designed to be used by voice alone while moving.
  • Not use the App for racing, timing trials, or any form of competition on public roads. Competitive use is permitted only on closed courses where such activity is lawful and authorised.
  • Be at least 18 years old and hold a valid driving licence when using the App while driving.
  • Not reverse-engineer, resell, or redistribute the App or its generated content, except as permitted by mandatory law.

3. Assumption of risk

Driving is inherently dangerous. You assume full responsibility for every decision you make while driving, whether or not the App is active. The App’s audio and visual output are aids to preparation and enjoyment, not instructions; you alone decide your speed, line, and conduct.

4. Disclaimer of warranty and limitation of liability

The App is provided “as is” and “as available”, without warranty of any kind, express or implied, including fitness for a particular purpose, accuracy, or availability.

To the fullest extent permitted by applicable law, the Developer shall not be liable for any direct or indirect damages arising from use of the App, including, but not limited to, accidents, personal injury, death, property damage, fines, or loss of data, even where caused by incorrect, mistimed, or missing pacenotes. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including liability for wilful misconduct or gross negligence under Italian law).

5. Third-party services and data

  • Map & routing data are derived from OpenStreetMap, © OpenStreetMap contributors, licensed under the Open Database License (ODbL).
  • When you create a stage by picking points on the map, coordinates are sent to the App’s own stage-building service (operated by the Developer on its own servers under tornanteapp.com) to compute the road path; if it is unreachable, the query may fall back to a public third-party map-data service. Map preview tiles are served by a third-party tile provider (CARTO). The optional Earth (satellite) map view uses imagery tiles served by Esri (World Imagery: Esri, Maxar, Earthstar Geographics, and the GIS User Community).
  • Elevation data derive from public digital-elevation datasets (Copernicus GLO-90, via the Open-Meteo API where not bundled). The weather summary shown on a stage is also provided by Open-Meteo.
  • Searching for a place by name sends the text you type to the OpenStreetMap Foundation’s public search service.
  • Third-party services are operated by their respective providers; the Developer has no control over their availability or accuracy and is not responsible for them. The Developer’s own services are provided on a best-effort basis with no uptime guarantee.
  • Distribution via TestFlight and the App Store is subject to Apple’s own terms.

6. Intellectual property

The App, its pacenote engine, its visual design, and its voice clip library are the property of the Developer (the co-driver voice consists of professionally licensed synthetic voice recordings, generated ahead of time under a paid commercial licence). You receive a personal, revocable, non-exclusive, non-transferable licence to use the App on your own devices. Stages you create or import remain yours; they are stored only on your device.

7. Changes, suspension, termination

The Developer may modify, suspend, or discontinue the App (or the beta programme) at any time without notice, and may update these Terms; material changes will be shown in the App. Continued use after a change constitutes acceptance.

8. Governing law and disputes

These Terms are governed by the laws of Italy, without prejudice to any more favourable mandatory consumer protection rules of your country of residence within the EU. Disputes shall first be attempted to be resolved amicably; EU consumers may also use the EU Online Dispute Resolution platform. Exclusive jurisdiction otherwise lies with the competent Italian courts.
